New Nevada Laws Taking Effect January 2026

Bills passed by the Nevada Legislature that will go into effect on January 1, 2026, include:

Assembly Bill 4 (AB4) – “Safe Streets Act”

  • Increases penalties for DUI cases involving a death.
  • Extends marijuana impairment standards to felony DUI cases, applying them to serious crashes that involve death or injury.

Assembly Bill 305 (AB305) – FMLA Certification Fee Cap

  • Caps the fee healthcare providers can charge for certifying Family and Medical Leave Act (FMLA) paperwork at $30.
  • Provides for future adjustments for inflation.

Assembly Bill 376 (AB376) – Wildfire Insurance Coverage

  • Allows insurers to exclude wildfire coverage from standard homeowners’ insurance policies.

 

Senate Bill 420 (SB420) – Nevada Public Option (originally passed in 2021, but operative in 2026)

  • Requires all health insurers wishing to continue in Nevada’s Medicaid managed care program to submit a good faith bid to offer and administer products for the state’s public option.

 

Unemployment Insurance Tax Changes

  • The taxable wage base for unemployment insurance in Nevada will increase to $43,700, up from $41,800 in 2025.

 

These laws will be effective January 1, 2026. Other notable bills mentioned, such as Assembly Bill 6 (AB6) regarding school zone traffic penalties, will go into effect July 1, 2026. Senate Bill 3 (SB3), the Silver State General Assistance Program, took effect earlier on November 18, 2025.
